Qkly Aap is a technology platform developed and operated by the Company to facilitate interaction, listing, communication, and transactions between independent users, vendors, service providers, and customers. The Company does not own, control, endorse, manufacture, sell, resell, supply, manage, or guarantee any products or services listed, offered, or provided by any third party on or through the platform.
The Company makes no representations or warranties, express or implied, regarding the quality, safety, legality, suitability, reliability, timeliness, accuracy, or completeness of any products or services offered by third parties through the platform. All such responsibility shall lie solely with the respective vendor, seller, or service provider.
Users shall independently verify the credentials, authenticity, quality, legality, and suitability of any vendor, service provider, or product before entering into any transaction. Use of the platform and reliance on any content is solely at the user’s own risk.
Nothing contained in this Agreement or use of the platform shall be construed as creating any agency, partnership, joint venture, employment, or fiduciary relationship between the Company and any user, vendor, or service provider.
The platform may contain links, references, advertisements, or integrations to third-party websites, applications, or services. The Company does not control or assume responsibility for any such third-party content, privacy policies, or practices and shall not be liable for any loss arising there from.
The Company does not guarantee uninterrupted, secure, error-free, or virus-free operation of the platform. Temporary suspension of services may occur due to maintenance, upgrades, technical issues, force majeure events, cyber incidents, or reasons beyond the Company’s control.
Information, listings, descriptions, pricing, availability, and other content on the platform are provided by users and third parties. The Company does not verify or guarantee the accuracy, completeness, or correctness of such information.
Payments processed through third-party payment gateways are subject to the terms and policies of such payment service providers. The Company shall not be responsible for payment failures, delays, fraud, charge backs, or technical errors attributable to such gateways.
The Company shall not be liable for any misuse of the platform by users, including fraudulent, illegal, defamatory, infringing, or unauthorized activities. Users shall be solely responsible for their conduct and content uploaded or shared on the platform.
Any information, suggestions, ratings, reviews, or communications on the platform shall not be construed as professional, legal, financial, medical, or technical advice.
Users, vendors, and service providers agree to indemnify and hold harmless the Company from any claims, damages, losses, liabilities, costs, or expenses arising out of their conduct, transactions, content, or breach of applicable laws.
The Company shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including natural disasters, government actions, internet failures, cyber attacks, strikes, or power outages.
The Company does not guarantee any minimum business, revenue, customer traffic, visibility, or success to any vendor or service provider using the platform.
The platform is provided on an “as is” and “as available” basis without any warranties of any kind, whether express or implied.
Users and vendors are responsible for ensuring that their use of the platform and their offerings comply with all applicable local, state, and national laws. The Company does not assume responsibility for regulatory compliance of third parties.
